Identify the legal path first
A sublet, assignment and lease takeover are not interchangeable. Read the lease for permission, fees, screening, occupancy limits and notice. Ask the landlord which process applies and whether the original tenant remains liable after approval.
Do not advertise promises the landlord has not authorized. A replacement person, a deposit and a key exchange do not amend the original lease by themselves.
Get five answers in writing
These answers determine whether the plan actually transfers risk.
- Is the arrangement permitted?Ask which clause and local rule govern the proposed dates and person.
- Who screens and approves?Use the property’s official application and do not collect unnecessary identity documents yourself.
- Who pays whom?Confirm rent, deposit, fees and refunds through the approved channel.
- Who remains liable?Ask whether the original tenant or guarantor still owes rent, damage or rule compliance.
- What ends the arrangement?Document dates, notice, keys, condition review and any return to the original tenant.
- What coverage applies?Confirm renter’s insurance, property coverage and liability for the temporary occupant.
Build an approved handoff
Do not skip from listing to keys.
- Request permissionSubmit the dates and proposed process through the landlord’s official contact.
- Verify the personUse the authorized screening route and independently confirm communications.
- Sign the correct documentKeep the approved sublease, assignment or reletting agreement with all required signatures.
- Record conditionPhotograph the unit, inventory furniture and document existing damage.
Close the loop after move-in
A clean handoff includes the final month, not only the first day.
- Key dayUse the property’s key and access process and keep proof of delivery.
- First paymentVerify that the official account reflects the approved payer and amount.
- During occupancyPreserve landlord notices and address violations through the named responsible party.
- End dateComplete inspection, key return, account transfer and deposit steps required by the written agreement.
